According to p. 4 Article 3 of the Federal Law of 21.07.1997 N 116-FL (version as of 13.07.2015) "On industrial safety of hazardous production facilities":
In case if during operation, overhaul, preservation or abandonment of hazardous production facility the deviation is required from industrial safety requirements established by the federal norms and regulations in the field of industrial safety, these requirements are insufficient and (or) they are not established by the individual executing design documentation for construction, reconstruction of hazardous production facility the industrial safety requirements can be established to its operation, overhaul, preservation and abandonment in the Substantiation of Safety of hazardous production facility.
Substantiation of Safety of hazardous production facility, as well as changes introduced to Substantiation of Safety of hazardous production facility is subject to industrial safety expertise. Use of Substantiation of Safety of hazardous production facility without positive conclusions of industrial safety expertise without this substantiation and introduction of changes to it (if any) is not allowed.
Substantiation of Safety of hazardous production facility shall be sent by the organization operating hazardous production facilities to the federal executive body in the field of industrial safety at registration of hazardous production facility in the State Register. Changes introduced to Substantiation of Safety of hazardous production facility shall be sent by the organization operating hazardous production facility to the federal executive body in the field of industrial safety during the period of ten working days from the day of receipt of positive conclusion of industrial safety expertise. Deviations from the current safety requirements for specific HPF can be reflected in PSTS (STU) (with regards to the requirements of mechanical, fire safety), and in HPF Substantiation of Safety (SSHPF) (with regards to industrial safety requirements) depending on the scope of these requirements.
Main methodical approach used for HPF Substantiation of Safety – hazards analysis (including HAZID/HAZOP) and accidents risk assessment at HPF (risk analysis).The results of risk analysis shall be used at the stage of development of SSHPF and design documentation considering the requirements of SSHPF, PSTS (if required), generalized and clarified in HPF Industrial safety declaration (ISD), which is part of design documentation.
